PREAMBLE
These General Terms and Conditions of Sale (GTC) define the conditions under which BIS COMMERCE , a simplified joint-stock company, whose registered office is located at 73, rue du Château, 92100 Boulogne-Billancourt (administrative headquarters only, no packages should be returned to this address) , registered under number RCS Nanterre B940443559 , markets and sells its products to consumers via the site bonjoursport.com (hereinafter "the Site").
BonjourSport is a trade name and website operated by BIS COMMERCE. It is a trading name used by the company for the online sale of its products.
Acceptance of these General Terms and Conditions implies the customer's full and complete adherence to the provisions set out. These conditions may be updated regularly to comply with legal requirements and market developments.

1. DEFINITIONS

Customer : Any adult natural person making a purchase on the Site.

These General Terms and Conditions define the terms and conditions of sale of the Products offered by the Seller on the Site. They specify in particular the conditions of ordering, payment, delivery, return and guarantees applicable to the Products.
3. PRODUCTS AND AVAILABILITY
3.1 Product Characteristics
The products available on the Site are described in detail, including their essential characteristics, their price, and any restrictions on use. Each product sheet is carefully written to provide the Customer with all the information necessary for their choice. Our product and service offers are valid while stocks last.
Images and descriptions are provided for guidance only. While we do our best to ensure the accuracy of the information, slight differences may exist.
3.2 Availability of Products
In the event of unavailability of a Product after validation of an Order, the Customer will be informed as soon as possible and will be able to choose between:

A full refund within 7 working days.

An exchange for an equivalent Product.

A credit usable on the Site for a period of 12 months.
If, despite our best efforts, a product becomes unavailable after your order has been validated, the Seller will inform you by email and will refund the price of the product or service initially ordered as well as any sum paid for your order. However, if your order contains other available products or services, these will be delivered to you and the delivery costs will not be refunded. You have the option to cancel your order before the Seller ships it.
4. PRICE AND PAYMENT
4.1 Price of Products
The prices displayed on the Site are indicated in euros including VAT and are subject to change. The price of products and services (excluding delivery costs) is that indicated on the corresponding product sheet, accessible on the Site. The Seller reserves the right to modify the price of its products at any time, in compliance with applicable legislation.
The products you order will be billed to you based on the price in effect on the Site at the time you place your order. Adding a product to your shopping cart does not guarantee its availability or that its price will be maintained.

6. DELIVERY AND RECEIPT
Packages are shipped the next business day after ordering for 90% of orders. For 10% of orders requiring additional verification (delivery address or payment confirmation), shipping takes place within 2 business days.
Delivery available to: France, Spain, Italy, Germany, Belgium, Netherlands, Portugal, Luxembourg, Monaco, Vatican, Austria, Denmark.
No delivery to relay points, only to homes.
The Customer must provide a mobile phone number to receive notifications from the carrier regarding delivery. The delivery person typically calls 15 to 30 minutes before delivery. An email is also required to allow for updating delivery information and providing additional instructions.
7. RIGHT OF WITHDRAWAL AND RETURNS
The Customer has a legal right of withdrawal of 14 calendar days , but BIS COMMERCE offers a commercial return policy extended to 30 days , provided that the products are returned in perfect condition, complete and in their original packaging.
In accordance with Article L. 221-28 of the Consumer Code , certain products are excluded from the right of withdrawal, in particular:

Products unsealed for hygiene reasons (e.g. underwear, swimwear, intimate protection, mouth guards, earplugs, sweating articles, etc.).

Personalized products.
Return costs are the responsibility of the Customer except in the event of a proven defect.
8. LEGAL GUARANTEES AND COMPLIANCE
8.1 Legal guarantee of conformity
Our warranty commitment is in line with current legal requirements. The legal guarantee of conformity covers 12 months for all products and 24 months for electronic products only.
However, warranty support is the direct responsibility of the manufacturer or brand of the product in question. As a distributor, we are only committed to providing administrative assistance, including providing necessary information, such as the manufacturer's contact details, procedures to follow, and the invoice proving the purchase. Product repair or replacement is handled entirely by the brand.
What is the legal guarantee of conformity?
This is a guarantee provided for by European Directives 2019/770 and 2019/771, transposed in France in Articles L.217-3 et seq. and L. 224-25-1 et seq. of the Consumer Code. It protects consumers when a product presents a lack of conformity, in particular if:

It does not work properly out of the box.

It is not suitable for the uses usually used by goods of the same type.

What are your rights in the event of non-conformity?

We do not replace or repair products directly, but we will assist you in the necessary steps to contact the manufacturer.
Duration and implementation
The legal guarantee of conformity applies to:

Our sales policy provides for a 30-day warranty claim for defects after receipt of the product. After this period, the warranty must be activated directly with the manufacturer.
How to invoke the legal guarantee of conformity?

8.2 Legal guarantee of hidden defects
In accordance with Articles 1641 et seq. of the Civil Code, a legal guarantee against hidden defects only applies if the defect was present upon delivery.
Conditions of application
To be admissible, a detailed and quantified reservation must be indicated on the delivery slip at the time of receipt of the product. This note must specify the exact nature of the problem observed (e.g.: damaged product, malfunction, missing part).
If no reservation is mentioned on the delivery slip, the guarantee for hidden defects cannot be invoked.
What are your rights in the event of a hidden defect?
If the product was delivered with a hidden defect documented on the delivery slip, you can:

Return the product for a full refund (including any sales charges).

Keep the product and get a price reduction.
Duration and implementation
The action for warranty against hidden defects must be brought within two years of the discovery of the defect. However, any claim that does not meet the above criteria (reservation on the delivery note) cannot be taken into account.

9. SELLER'S LIABILITY
